TERMS & CONDITIONS

1. Introduction

Welcome to NJORD! We are your supplier of personalized supplements of the highest quality through our subscription service.

Our services and products are delivered through NJORD Nutrition ApS, a Danish company with limited liability. These terms and conditions applies to your use of our subscription services. In these terms and conditions, references to “subscription service”, “services and products”, “our services” or “our products” mean the subscription service which NJORD offers and which provides the users with a possibility to receive information regarding nutritional supplements and the supply hereof, including the use of features, the website and user interfaces, and use of all content and software associated with the subscription service.

2. Order

Once you have placed an order, you will receive an online confirmation. Should you against expectations not receive this confirmation within 1 hour, please contact us. You will in addition receive a new email on the day that your order is shipped.

3. Subscription

Your NJORD subscription continue each month until it is cancelled. Unless you cancel the subscription before the bi-monthly renewal date, you grant us permission to draw payment for the next 2 month’s subscription via the chosen payment solution (see “Cancellation” below). You need to have internet access, a NJORD-compatible device and provide a valid and accepted payment solution, which at any time can be updated (see more under “payment solutions”). You can see detailed information about your NJORD subscription by logging into our website under “My Profile” which can be found in the top right corner on any page on njordnutrition.com.

4. Shipping and shipping costs

NJORD delivers on all working days. Delivery occurs in accordance with your subscription and you can always be updated at www.njordnutrition.com/my-account. From you subscribe the first day until first delivery, a period of up to 10 working days can occur.

We pay the shipping unless otherwise specifically stated. The price of shipping can depend on the chosen shipping form. You will always be able to clearly see what the shipping costs are before you order your product.

When shipping the first order when the subscription starts and the NJORD jar is shipped, a “Track-and-Trace” number will be send to you, so that you can follow the order from our storage to your delivery place.

5. Invoicing

Invoicing period

First payment will be withdrawn on your account when your first order is shipped. Afterwards, we will invoice you for the subscription service each month via the chosen payment solution on the calendar day corresponding to the start date of your subscription service. In certain circumstances, the time of invoicing can change, for instance if a payment cannot be completed or if the subscription starts on a date which does not exist in a given month. Payment solutions

We offer multiple payment methods. The most secure – and the payment method we recommend all customers – is to pay with a credit card. We offer the following card types:

  • MasterCard
  • MasterCard Debit
  • Maestro

You can change your payment method by going to www.njordnutrition.com/my-account. If a payment cannot be completed due to expiry, insufficient funds or similar, and you do not change the payment method or cancel your subscription, we can suspend your access to the subscription service until we receive a valid payment method. You grant us permission to continue the payment method with any changes and you are liable for non-drawn payments. This can result in your invoicing dates being changed. For some payment methods, the issuer can require a fee for transactions or other fees. Please refer to the issuer of the payment method for further information.

NJORD uses an approved payment server that encrypts all your card information with SSL (Secure Socket Layer) protocol. That means that others cannot read your information.

When you shop with a credit card, we reserve the right to control that the personal information provided are true. We can at any time reduce the paid amount – if for instance a product is sold out or refunded. But due to security reasons, we can never increase the approved amount without prior approval.

Cancellation

You can cancel your NJORD subscription any time to the next renewal date. If you have received products which are not fully paid, you must pay for such products. You will continue to have access to the NJORD website and your personal profile after you have cancelled the subscription but we reserve the right to suspend your access if found necessary. We do not grant refunds or credit for partly used subscription months or product in excess. To cancel the subscription, please go to www.njordnutrition.com/my-account and follow the instructions. If you cancel the subscription, the delivery of services and products will stop automatically by the end of the current invoicing period. Price- and subscription changes

From time to time we can change our subscriptions and the price of them. However, price- or subscription changes will at the earliest be in force 30 days after you have received notice hereof via email. You will have the opportunity to cancel the subscription in such instances.

All amounts are in euro (unless otherwise specifically indicated) and are inclusive of VAT.

6. Discount periods

Your NJORD subscription may start with a discount period. The discount period is stated when subscribing and the intention is to let new customers and certain existing customers try the subscription service. When you subscribe, you will be informed whether you fulfil the conditions for a discount period.

We invoice the monthly subscription at the end of the discount period via the chosen payment method unless you have cancelled the subscription before the bi-monthly renewal date. Go to www.njordnutrition.com/my-account to see the monthly subscription price and when the discount period ends. You will not receive notice from us concerning commencement of the regular subscription price.

7. NJORD services and products

Age

You must be 18 years or older, or be of legal age in the province or the area or country where you live to become a customer with NJORD. Minors can only use the services under supervision of an adult.

Only for personal use

The NJORD service and content available through the services may only be used for your personal and non-commercial use. You accept that you cannot use the services for commercial purposes.

Locations

We reserve the right to reject delivery in certain countries due to legal requirements that makes us unable to supply our products in its current state, or other factors that results in us being unable to deliver.

Updates

We continuously update our services and products, including its content. In addition, we continue to test various aspects of our services, including our website, user interfaces, campaigns and available services and products. We notify our customers of all changes to the specific product.

Copy, re-create, data mining etc.

You accept to use the NJORD service, including all features related hereto, in accordance with applicable law, rules and orders or other restrictions on the use of the service or the content hereof. You further accept that you may not: bypass, remove, modify, disable, impair or impede any securities on the content; try to access the NJORD service with a robot, spider, scraper or another automatic mean; decompile, make reverse engineering or disassemble the software or other products or processes which is accessible through the NJORD service: insert code, products or manipulate the content of the NJORD service in any way; or make use of data mining, data gathering or data extraction. In addition, you accept that you may not upload, post, email or in other way send or transfer material that is intended to turn-off, destroy or limit the functionality of software, hardware or communication equipment related to the NJORD service, including software viruses or other computer code, files or programs. We can stop or limit your use of our service if you are not compliant with these terms and conditions or involvement in illegal or fraudulent use of the service.

8. Password and profile access

Ownership and protection of your profile

The user that created your profile and whose payment method is being debited (the “account owner”) has access to and control over your profile. To retain control of the profile and to avoid that others gain access to it (which can include information regarding the history of the account), you should never show your password or details of the payment method (for instance the last 4 digits on your credit card or you e-mail if you are using PayPal) which connected to your profile to others. You are responsible for updating and securing the correctness of the information you have provided us about your profile.

Access to the NJORD website

You should be careful in relation to messages or similar that asks you about payment card- or other account information. If you receive such messages and you provide such information, it can result in identity theft. Always access sensitive account information by going directly to the NJORD website and not through hyperlinks in an email or other electronic messages – including in instances where it appears official. We can cancel your subscription or put your profile on hold to protect you, NJORD or our partners against identity theft or other fraudulent activity.

9. Warranty and cancellation

Warranty

We provide a 2-year warranty in accordance with the Danish law. Our warranty covers errors in material and/or production. The warranty does not cover errors or damages due to wrong handling of the product. In case of a justified warranty claim, NJORD will cover return costs at a fair level.

NB! We do not receive parcels sent per demand or similar. You are asked to inform us on the issue as detailed as possible. Remember that the product should always be returned in proper packaging.

Cancellation

Since our product is bespoke to you and is a food product, we can unfortunately not offer you a cancellation right.

10. Typos and similar

NJORD make reservations for typos, pricing errors, VAT- and other tax changes and sold out products and failure of delivery by our suppliers.

11. Applicable law

These terms and conditions are governed by and interpreted in accordance with Danish law. These terms and conditions will not limit any consumer rights you have in accordance with mandatory law in your country of residence.

12. Third party applications

You can encounter third party applications (including but not limited to websites, widgets, software or other tools) that integrates with the NJORD website or in connection with delivery of our services and products. Your use of these applications can be subject to a third party’s terms and conditions or license terms.

13. Customer support

Go to www.njordnutrition.com/contact for more information on our services and the features of it or if you need assistance with your profile. In the event of a conflict between these terms and conditions and information from our customers support or other parts of the NJORD website, these terms and conditions shall prevail.

14. Validity

If one or more provisions in these terms and conditions are found to be invalid, illegal or unenforceable, the other provisions shall continue to be in full force and effect.

15. Changes to the terms and conditions

NJORD may from time to time choose to update these terms and conditions. We will provide you with a notice no later than 30 days prior to such updates being applicable to you.

16. Complaints – overview and links:

If you have any complaints about a product, you can send a complaint to the Danish Competition and Consumer Authority’s Center for Complaints, Carl Jacobsens Vej 35, 2500 Valby, Denmark, link: www.forbrug.dk.

If you are a consumer with residence in another EU country, you can make your compliant in the EU Commissions online platform for complaints: http://ec.europa.eu/consumers/odr/.

17. Electronic communication

We send you the information about your profile (for instance payment confirmations, invoices, changed passwords or payment method, confirmations and messages) in electronic form only – most often to the email address you provide when subscribing.
